We are specialists in SME product and service promotion, PR, marketing and advertising campaigns including website text and Google ad-word advertising. The Advertising Standards Authority (the “ASA”) is the UK’s independent regulator of advertising across all media, broadcast and non-broadcast. It does this by administrating two main codes through the Committee of Advertising Practice (CAP), and the Office of Communications (Ofcom).

Non-Broadcast Media

The Committees of Advertising Practice (CAP) are responsible for writing and enforcing advertising, direct marketing and sales promotions using the UK Non-Broadcast Advertising CAP Code.

Broadcast Media

The Office of Communications (Ofcom) oversea the the broadcast codes BCAP for all broadcast media including TV, radio, on-demand video, fixed line telecoms and wireless broadband.

What We Do

We provide specialist legal advice to clients who are subject to an informal or formal investigation by CAP or/and Ofcom. We assist clients in their negotiations with the ASA to feed into an acceptable solution allowing advertising material to continue or to continue with approved disclaimers or some other mutually agreed restriction. We assist in applications for broadcast licenses.
We assist in appealing adverse decisions on all regulatory issues including competition and promotion. Non-compliance with the codes or repeat offences result in sanctions that can damage the reputation of your business, or some very restrictive conditions on your ability to publish advertising and marketing material, or in the worst-case scenario shut down your business completely.
