What is Harassment?

Harassment is when you are being targeted by another or others for no legitimate reason causing you distress. This can include a company continuing to threaten you with payment of a bill that has already been paid and you have notified them that it has been paid but they continue to write threatening letters for example.

What can you do about it?

Although it is a criminal offence UK law provides the option of suing through the civil courts. You have to meet the test that the relevant law states as the criteria to establish that the other person is guilty of harassing you. Once you can meet the test standards the court will grant you an injunction to protect you and if you are ultimately successful at trial compensation for your suffering.

Can a company be harassed?

The short answer is no. A company cannot be harassed. 

In the case of Kosar v. Bank of Scotland Plc [t/a Halifax]: QBD [Admin] [Mr Justice Silber]

The appellant (Kosar) appealed against a district judge`s decision that the offence of harassment under section 2[1] of the Protection from Harassment Act 1997 could only be committed by a person who was an individual against another individual person. The judges allowed the appeal. They held that a Company can be a person for the purposes of the Act when they are the perpetrators of harassment but not as victims of harassment.


However, it is possible to harass individuals in a company, if there is evidence that they are being targeted as individuals. If a disgruntled customer singles out an employee of a company for hostile treatment that causes that employee distress then that employee can sue for harassment.
