What is intellectual property?
There are four main types of intellectual property, that are designed to protect types of intellectual products. The four are patents; copyrights; trademarks; and trade secrets. Of these 4 patents are probably the strongest form of intellectual property protection when it comes to NFTs. Copyright does not cover purely functional expressions of an idea therefore it would appear that the NFT itself would not qualify however, most copy has enough originality to receive at least weak copyright protection, and the underlying asset on which the NFT is based would one hundred per cent qualify if it is an original creative expression of an idea. Trademarks would protect the name of the NFT. Trade Secrets would only apply to the asset underlying the NFT.
Why do we have intellectual property laws?
The purpose of intellectual property protection is to allow individuals to be paid for the investment and risk associated with creating and to balance the need for an incentive for creative people to innovate and for society to benefit from their creations. When you own the copyright to your NFT, you can license the NFT for a fee, but you retain the copyright in the underlying work that the NFT represents in part or whole.
